The rules don't apply to Desmond, meaning that someone can interact with him in the past and it dose not change his entire time line. It changes Desmond's memory in real time. So whatever time it "truly" is, that's when Desmond picks up that memory.

Meaning that yes, we are seeing Desmond and Penny during the same time as Jack and the rest; three years later.
