Couple of things:

1. That amnesty clause is old. It's from the 2005 CBA, and we've already used it (Finley). There is a thought that if a hard cap is brought into place, there will be an amnesty clause to allow teams to remove someone from their salary cap. So the waiving would be after the new CBA.

2. No, I don't think the Mavs would waive Marion, it was just a thought brought up by Skin.

This is all just pure speculation, and I would say the chances of us having a hard cap next season are basically nil. Maybe the owners win and one is put in place in a few years, but that would probably remove the need for an amnesty clause for the immediate future.
